What is termination without notice? (Austria)

Termination without notice is an extraordinary termination that can be given by the landlord for the following reasons:

  • Serious payment delay
  • Continuation of the misbehaviour despite a warning
  • Gross violation of morality and/or house rules

 

Termination without notice due to payment delay can be cured by payment.

 

Moving out due to termination without notice does not automatically release the tenant from his obligation to pay. In the case of fixed-term tenancy agreements, the landlord may claim loss of rent in the amount of the net cold rent until the end of the tenancy agreement or until the new tenancy.

 

If the tenant neither moves out nor pays his outstanding debts, an eviction action must be initiated. This is associated with considerable costs for the tenant.
